ALBERT TERMS & CONDITIONS

Hi and welcome as a user of Albert!

These are our terms of use and below you will also find our privacy policy. It is important that you carefully read this document because it describes your rights but also a number of obligations that you have as a user. In our privacy policy, we also describe how we treat your personal information, what we do to protect them and where to turn to if you have any questions about our personal data processing. Thank you for choosing to use our service!

  1. TERMS

    These Terms of Use including the Privacy Policy below ("Terms") are set up by eEducation Albert AB, org. No. 559020-9093, ("Albert" or "We/Us/ Ours"). The terms and conditions apply to you as a private or legal person ("Customer" or "You/ your/ yours") who (i) registered as a user on Alberta's internet service, and / or in any of Albert's applications (collectively "the Service"), or (ii) entered into a separate subscription agreement for the use of the Service. The terms and any separate subscription agreement constitute the agreement ("the Agreement") concluded between the Client and Albert.

    For customers under 18 years old:

    If you are a Client under the age of 18, both you and your custodian will accept these Terms on your behalf. By agreeing to these Terms and Conditions, you confirm who is the guardian of a Customer under 18 years of age that you agree that the Agreement is concluded between Albert and the Customer. Albert reserves the right to contact the guardian to confirm that a valid consent has been given.

  2. SERVICE & PAYMENT

    1. The service

      The Service means Albert's Digital Learning Service, including all functionality, all interfaces and all content (including all text and music, all images and movies, as well as all underlying data and software) that Albert may access from time to time through the Services on Websites and in various applications. Certain parts of the Service may from time to time be provided free of charge. Other parts of the Service must be paid before you can use them. The parts of the Service that can be accessed only after payment are called "Payment Service". The parts of the Service that do not require payment are called the "Free Service". You can read more about the Service by visiting our website www.hejalbert.se.

    2. Changes in the Service

      Albert reserves the right to change and update the Service at any time, which means that, for example, the content, structure, functionality and search system of the Service may change over time.

      If a change to the Service has not been notified by Albert at least one (1) month in advance and it substantially degrades your service (eg, if your teaching material is completely removed from the Service), you are entitled to terminate the Agreement and if you Using the Payment Service, you may also require repayment of already paid subscription fee up to a reasonable amount corresponding to what remains of the current subscription period. You can only claim a refund if you also terminate the Agreement (see paragraph 4 below on how this applies). If you continue to use the Service after a change has been made, you will be deemed to have approved the change. In addition to the above, you agree that you can not claim any liability or claims against Albert because the Service is changed as described above.

    3. Codes and other prepaid offers

      From time to time, codes, gift cards, prepaid offers and other similar offers that provide access to the Payment Service (hereinafter "Codes") may be provided or sold by or on behalf of Albert. If you use a Code to access the Payment Service, you may be aware that special terms apply to the Code, which may also include terms of your access to the Service. You hereby consent to comply with all such special terms, which will be deemed to form part of the Agreement between you and Albert.

    4. Try on-subscription

      Occasionally, we, or others on our behalf, can offer a trial of variants of the Payment Service for a certain amount of time, without payment or at a reduced price (a "Try on-subscription"). The purpose of a Try on-Subscription is that users should be able to test the Payment Service, or parts of, for a limited period of time to form an opinion about the Service. Albert reserves the right, at its discretion, to delimit the Trial subscriptions and to withdraw or modify a Trial subscription at any time without notice and without liability, to the fullest extent permitted by applicable law.

      For some Try Subscriptions, we will require you to submit your payment information to start the Try-In subscription. WHEN SUCH PROCEDURE IS REQUIRED, WE CAN AUTOMATICALLY BALANCE YOU FOR THE PAYABLE PAYMENT FROM AND ON THE FIRST DAY AFTER THE FAILURE OF THE SUBMISSION'S DELIVERY, ON A RECOMMENDED MONTHLY BASIS. BY CALLING YOUR PAYMENT DETAILS IN CONNECTION WITH THE PROMOTION OF THE SUBSCRIPTION, YOU ACCEPT THAT WE DEBIT YOU THIS PAYMENT WITH USE OF CUSTOMER PAYMENT DETAILS. IF YOU DO NOT WANT THIS PURCHASE, YOU MUST SIGN UP THE ACTUAL PAYMENT OF THE SUBSCRIPTION BY YOUR CONTACTS PAYMENT PAGE OR CONCLUDE YOUR ACCOUNT BEFORE TRYING THE SUBSIDIARY. IF YOU DO NOT WANT TO BE DEBITED ON A RECOMMENDING MONTHLY BASIS, YOU MUST SIGN UP THE ACTUAL PAYMENT SUBSCRIPTION BY YOUR CONTACTS SUBMISSION PAGE OR EXCLUDE YOUR ACCOUNT BEFORE THE PURPOSE PAYMENT PERIOD ENDS. PAYABLE SUBSCRIPTIONS CAN NOT BE SENT UP BEFORE EXPENDITURE OF THE PERIOD YOU HAVE BETWEEN.

  3. LICENSE SUBMISSION AND YOUR RIGHTS AS A USER

    1. Immaterial rights

      The service and all immaterial property rights attributable thereto belong to Albert and/or to Alberts licensors. All rights not expressly granted to the Customer under the Agreement are reserved to Albert. The agreement thus does not imply that any immaterial property or part of such right, in addition to the right of use specified in the Agreement, is transferred to the Customer. This also means that you do not have the right to analyze, investigate, modify, copy, distribute, sell or otherwise dispose of the Service, other than (i) pursuant to this Agreement or mandatory applicable law, or (ii) ) if you have obtained Alberta's prior written consent at such disposal.

    2. License

      Albert hereby gives you a non-exclusive right to use the Service during the term of the agreement (see paragraph 4 below regarding the term of the agreement) under the terms of this Agreement and with the rights and limitations that you have either enabled the Payment Service or use the Free Service. The license is granted to a particular named person, or to a certain number of users, as agreed in any separate subscription agreement or at Customer's registration. The following conditions also apply to individuals and legal entities:

      A) Private person

      Private subscription users are entitled to use the Service for individual use. Each user account is personal and may not be shared with others. Access to the Service is obtained when registration has been completed and the Terms are accepted. The service is deemed to be delivered when the Customer has access to the Service after registration has been completed and the Terms have been accepted.

      B) Legal person

      Subscribers with legal person may use the Service for the number of users agreed upon signing a subscription agreement. The Customer is in charge of Albert to ensure that its users comply with this Agreement. Access to the Service is obtained once upon the registration has been completed. Terms are accepted and necessary information for access of the Service has been received by a contact person designated by the Customer via email. Required information for access to the Service will be sent as soon as contact information has been provided by the Customer and these have been registered by Albert. The service is considered delivered when data for access to the Service has been sent to the Customer.

      Use of the Service at school

      Content such as pedagogy, hints, samples, text, image and film material provided in the Service, which is produced by Albert may be used freely in Schools that are Customers, who pay for licenses per student and per teacher based on the number of students and teachers at beginning of the academic year or when an agreement was reached regarding the use of the Service. This means that teachers registered for the Service may print and copy materials for use with their classes, and that students may use material from the Service in group work and school accounts.

    3. User content

      You retain the right of ownership and any immarterial property rights to any content you may create within the Service and any feedback that you otherwise give to Albert ("User Content") but by entering into this Agreement, you grant an unlimited non-exclusive license for the time being Albert to use such User Content in order to further develop and market the Service, including the right to modify User Content and to sublicense this to third parties. You acknowledge and agree that this license will remain in effect even if the Agreement is terminated, regardless of the reason for such termination.

  4. AGREEMENT, UNSUBSCRIPTION AND SUSPENSION

    1. Timeagreement and unsubscrition without a specific reason

      This Agreement applies until it is terminated by either you or Albert. Both you and Albert are entitled to terminate the Agreement and your use of the Service at any time and without special reason. If you use the Payment Service, this Agreement will terminate and your right to use the Service when your current paid subscription period expires. If you use the Free Service, the Agreement and your right to use the Service will terminate immediately.

    2. Termination due to breach of contract

      Albert is entitled to terminate this Agreement with immediate effect if the Customer violates the Agreement in any material respect. You acknowledge and acknowledge that you are aware that you may be required to replace Albert for any damage suffered by Albert as a result of a breach of contract, for example if you have the Service in violation of the license terms in paragraph 3 above or allow others to gain unauthorized access to the Service.

    3. Temporary Suspension of the Service

      Albert may temporarily restrict or suspend your access to the Service from time to time. This can for example depends on Albert performing maintenance on the Service. Albert also has the right to block your access to the Service if you actually have or Albert has reasonable reason to suspect that you have used the Service, its content or Alberts immaterial property rights in violation of these Terms, or otherwise violated the Agreement. If you do not pay your subscription fee on time, Albert is also entitled to block your access to the Payment Service, or replace it with the Free Shipping Service, until the payment has been made.

    4. No compensation

      If you or Albert terminate the Agreement or if Albert discontinues your access to the Service above, you agree that Albert, as far as permitted by applicable law, has no liability or obligations to you and that Albert will not repay Any amount that you have already paid, except in the cases specified in section 2.2 above.

  5. CANCELLATION

    According to the Act (SFS 2005: 59) on distance contracts and agreements outside the business premises (distance contract law), you have a consumer right of withdrawal for 14 days after the date of signing the subscription agreement. If Customer wishes to exercise the right of withdrawal within this time frame, Customer may terminate his subscription under My Profile and Payments.

  6. SUBMISSION AND TRANSFER OF ACCOUNT

    The Customer is not entitled, without Albert's consent, to assign or transfer its rights or obligations under the Agreement. Albert is entitled to transfer the Agreement or any part of them and Albert is entitled to delegate some or all of his obligations under the Agreement. You may not transfer the Agreement or any part of them, nor transfer or sublicense your rights under the Agreement to any third party.

  7. USE AND RESPONSIBILITY

    Customer may not use the Service in violation of the Agreement or in violation of applicable laws and regulations.

    The Customer undertakes not to disclose any username and password for any unauthorized person, and to ensure that any such actions such as username and password for the Service are stored in such a way that unauthorized persons can not access them. The Customer shall promptly notify Albert if any unauthorized person has been informed of the Customer's password or otherwise obtained unauthorized access to the Customer's account. In the event that Albert finds that Customer's username and password are abused, Albert is also entitled to assign a new username and password to the Customer.

  8. SUPPORT

    Albert gives support via Email Service, and we always try to respond within 24 hours, although we can not always guarantee that you will receive answers within this time. Support is via support@hejalbert.se.

  9. MESSAGES

    Messages from Albert to the Customer, which are sent to the Customer's e-mail address and/or to the Customer's designated mobilephone number, shall be deemed to be received within one day after the request. It is your obligation to notify Albert if you change contact information, and Albert reserves the right to trust that the contact information you have registered with is correct.

  10. RESPONSIBILITY AND LIMITATIONS

    Albert warrants that Albert has rights to the Service's license under these Terms.

    Albert takes no responsibility for any errors in the Service Content or in connection with availability and you confirm that you understand that no software or digital service is completely flawed and that, for example, errors may occur in the Service. Albert is also not liable for any damage, directly or indirectly, caused or arising from the use of the Service, including any damage that occurs if the Service can not be used as intended, for example, if the Service happens to be temporarily down or disturbances occur.

  11. CHANGED TERMS

    Albert reserves the right to change the Terms and Conditions from time to time. Notice of change is given on the Service website within 14 days before the change is put into force, as well as notification to the Customer via the specified contact information to the specified address within the same timeframe. Changes are binding to the Customer unless the change implies a significant inconvenience to the Customer, and within 7 days after receiving the notice of the forthcoming change, Albert informs of immediate termination of the Service. The agreement then expires as soon as Albert has received notice of termination.

  12. APPLICABLE LAW AND CONFLICT SOLUTION

    Conflicts in connection with this Agreement between Albert and the Customer shall be settled by a Canada court using Canada law.
